The Regulations specify the conditions for concluding and terminating the product sales contracts and the procedure for complaints, as well as the types and scope of services provided electronically by the Store. Games.

In matters not covered in these Regulations, the provisions apply:
of the Act on the provision of electronic services of July 18, 2002,

Act of the Civil Code of April 23, 1964 and other relevant provisions of Polish law.
§ 2Definitions contained in the Regulations

Customer - a recipient who intends to conclude or concluded a sales contract with the Seller.
Consumer - a natural person who performs a legal act with the entrepreneur not directly related to his business or professional activity.
Entrepreneur - a natural person, a legal person and an organizational unit who is not a legal person, whose act grants legal capacity, conducting business or professional activity on his own behalf.
Product - a movable item available in the store, which is the subject of a sales contract between the customer and the seller.
Regulations - these Store Regulations.

Sales contract - Product sales contract concluded between the customer and the seller via the store.
Order - a statement of the customer's will constituting an offer to conclude a product sales contract with the seller.
Price - the value expressed in money units, which the customer is obliged to pay the seller for the product.
§ 3Information on products and their ordering

The products offered in the store are new, in line with the contract and have been legally introduced to the Polish market.
The information on the store's websites does not constitute an offer within the meaning of the law. When placing an order, the customer plays an offer to buy a specific product on the conditions given in its description.
The price of the product shown on the store's website is given in Polish zlotys (PLN) and contains all the ingredients. The price does not include delivery costs.

The condition for placing an order in the Store by the Customer is to read the Regulations and accept its provisions while placing the order.
§ 4Conclusion of a sales contract
To conclude a sales contract, it is necessary for the Customer to place an order in advance by the Seller, in accordance with § 3 item 5 and 6 of the Regulations.
After placing the order, the Seller immediately confirms its receipt.
Confirmation of acceptance of the order referred to in point 2 of this paragraph causes the Customer to be bound by its order. The order is confirmed by sending an e-mail.
Confirmation of receipt of the order includes:
confirmation of all relevant elements of the order,
These regulations containing an instruction on the right to withdraw from the contract.
When the Customer receives an e-mail referred to in point 4 of this paragraph, a sales contract between the Customer and the Seller is concluded.
Each sales contract will be confirmed by the proof of purchase, which will be attached to the product.
§ 5Payment methods
The seller provides the following payment methods:
Payment by traditional transfer to the Seller's bank account,
Payment via an electronic payment system.
In the case of payment by traditional transfer, the payment should be made to bank account number: 13 1240 1037 1111 0010 5412 8937. (Bank Pekao SA) in the title of the transfer should enter "Order No. ...".
In the case of payment via an electronic payment system, the Customer shall make payment before the contract is started. The electronic payment system allows you to make payments via a credit card or quick transfer from selected Polish banks.
The customer is obliged to pay the price under the Sales Agreement within 7 business days from the date of its conclusion, unless the sales contract provides otherwise.
The product will be sent only after it is paid.
§ 6Cost, date and methods of product delivery
The cost of delivery of the product that the customer covers is determined during the ordering process.
The product delivery date consists of the time to complete the product and the product delivery time by the carrier:
The time of completing the products is up to 3 business days,
Delivery of products that are movable items by the carrier shall take place within the period declared by him, i.e. up to 7 business days from the moment of sending the parcel (delivery is only on business days, excluding Saturdays, Sundays and holidays).
Products purchased in the store are sent only in Poland via Poczta Polska or a courier company.
§ 7Product complaint
Complaint due to the lack of compliance of the product with the contract.
The basis and scope of the seller's liability to the Customer who is a consumer due to the lack of compliance of the Product with the Agreement are specified in the Consumer Rights Act of 30 May 2014,
The basis and scope of the seller's liability to the Customer who is an entrepreneur, under the warranty, the Civil Code of April 23, 1964, as well as the warranty, are specified in the Act,
The seller is responsible for the customer who is a consumer for the lack of compliance of the product with the contract existing at the time of delivery of the product and disclosed within 2 years from that moment, unless the product's shelf life specified by the seller or persons on his behalf is longer,
Notifications about the lack of compliance of the product with the contract and submitting the appropriate request can be made via e -mail to the following address: fundacja@projektjawniądzydzy.com or in writing to the following address: ul. Biskupia 38, 04-216 Warsaw.
In the above message in writing or electronic form, as possible as possible of information and circumstances regarding the subject of the complaint, in particular the type and date of irregularities and contact details. The information provided will significantly facilitate and accelerate the recipient of the complaint by the seller,
To assess the irregularities and non -compliance of the product with the contract, the consumer is required to provide the Seller's product, and the seller is obliged to collect it at his expense,
The seller will respond to the customer's request immediately, no later than within 14 days of the complaint,
In the case of a consumer customer complaint - failure to submit a complaint within 14 days of its notification is synonymous with its inclusion,
In connection with a justified complaint of the Customer who is a consumer, the seller, respectively:
covers the costs of repair or replacement and re -delivery of the product to the customer,
reduces the price of the product (the reduced price must remain in the proportion of the price of the goods in accordance with the contract not compatible with the contract) and returns the value of the reduced price to the consumer within 14 days of receiving the declaration of price reduction from the consumer,
If the consumer withdraws from the contract - the seller returns the price of the Product at the latest within 14 days from the date of receipt of the returned goods or the proof of its reference. In the event of withdrawal from the contract, the consumer is obliged to immediately return the goods to the seller at the expense of the seller,
The response to the complaint is transferred on paper or other durable medium, e.g. email or SMS.
§ 8The right to withdraw from the contract
Subject to point 10 of this paragraph, a customer who is also a consumer who has concluded a distance contract may withdraw from it without giving reasons, making a relevant statement within 14 days.
In the event of withdrawal from the contract, the sales contract is considered reliable, and the consumer is required to return the product of the seller or transfer it to a person authorized by the Seller to collect immediately, but not later than 14 days from the day on which he withdrew from the contract, unless the seller proposed that he will receive the product himself. To keep the deadline, it is enough to send back the product before its expiry.

The consumer is responsible for reducing the value of the product that is the result of using it in a manner that goes beyond the necessary character, features and functioning of the product, unless the seller did not inform the consumer or entity referred to in § 10 of the manner and date of the performance of the right to withdraw from the contract and did not provide him with the template for the withdrawal form. In order to determine the character, features and functioning of products, the consumer should handle products and check them only in the same way he could do it in a stationary store.
Subject to point 6 and 8 of this paragraph, the seller will refund the value of the product along with the costs of its delivery using the same payment method that the consumer used, unless the consumer clearly agreed to a different refund that does not involve any costs for him. Subject to point 7 of this paragraph, the return will take place immediately, and at the latest within 14 days from the moment the Seller receives a statement of withdrawal from the sales contract.
If the consumer has chosen the method of delivery of the product other than the cheapest ordinary delivery method offered by the store, the seller is not obliged to reimburse him additional costs incurred by him.
If the seller has not proposed that he will receive the product from the consumer, he may refrain from returning payments received from the consumer to the moment of receiving the item back or provide the proof of reference, depending on which event will take place earlier.
The consumer departing from the sales contract, in accordance with point 1 of this paragraph, only bears the costs of sending the product to the Seller.
The fourteen -day period, in which the consumer may withdraw from the contract, counts for the contract for which the seller issues the product being obliged to transfer his property - from the day on which the consumer (or the third party indicated by him other than the carrier) took the product possession.
The right to withdraw from a distance contract is not entitled to a consumer in the case of a sales contract, in which the subject of the benefit is a non -refined goods, produced according to the consumer specification or serving to satisfy his individualized needs.
The right to withdraw from the sales contract is entitled to both the seller and the customer in the event of the other party failure to perform his obligation within a strictly specified period.
§ 9Type and scope of electronic services
The Service Provider enables the Store to use the electronic service which is the conclusion of product sales contracts.
The provision of electronic services to service recipients in the Store takes place on the conditions specified in the regulations.
The service provider has the right to place advertising content on the store's website. These content is an integral part of the store and the materials presented in it.
§ 10Conditions for providing and concluding contracts for the provision of electronic services
The provision of an electronic service specified in § 9 point 1 of the Regulations by the Service Provider is free.
The agreement for the provision of an electronic service consisting in enabling the order in the Store is concluded for a fixed period and is terminated as soon as the order is placed or the Service Rebells to be placed.
Technical requirements necessary to cooperate with the ICT system used by the Service Provider:
computer (or mobile device) with internet access,
access to e -mail,
web browser,
Turning on a cookie and javascript in the web browser.
The Service Recipient is obliged to use the Store in a manner consistent with the law and decency, taking into account the respect for personal rights and intellectual property rights of third parties.
The Service Recipient is obliged to enter data in accordance with the facts.
The recipient is prohibited from providing unlawful content.
§ 11Complaints related to the provision of electronic services
Complaints related to the provision of electronic services via the Service Service Store may submit via e -mail to the following address: fundacja@projektjawniądzywy.com.
In the above e-mail, provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of irregularities and contact details. The information provided will significantly facilitate and accelerate the service of the complaint by the Service Provider.
The service provider is considered immediately, no later than within 14 days from the moment of notification.
The Service Provider's response regarding the complaint is sent to the Service Recipient's e-mail address provided in the complaint or in another manner provided by the Service Recipient
§ 12Final provisions
Agreements concluded through the Store are concluded in accordance with Polish law.
In the event of non -compliance of any part of the Regulations with applicable law, the relevant provisions of Polish law shall apply in place of the challenged provision of the Regulations.
Any disputes arising from sales contracts between the store and consumers will be resolved in the first place through negotiations, with the intention of the amicably end the dispute, taking into account the Act on non -court resolution of consumer disputes. However, if this would not be possible, or it would be unsatisfactory for either party, disputes will be resolved by the competent common court, in accordance with point 4 of this paragraph.
Possible disputes arising between the Service Provider and the Service Recipient (Customer) who are also a consumer are subject to the court competent in accordance with the provisions of the Code of Civil Procedure of November 17, 1964.
The customer who is a consumer also has the right to take advantage of out -of -court ways to settle disputes, in particular by submitting a request to initiate mediation or request for consideration of the case by the arbitration court after completing the complaint procedure (the application can be downloaded at http://www.uokik.gov.pl/download.php?plik=6223 ) . The consumer may also benefit from the free assistance of the poviat (municipal) consumer ombudsman or social organization, to which statutory tasks include consumer protection.
